Democrats Beg Justice Sonia Sotomayor to Retire Now So Biden Can Replace Her With Another Leftist
Imagine being under seventy and being told, not exactly politely, that in the interests of liberalism you need to be put out to pasture. When that message was delivered to Justice Stephen Breyer in 2021, he was in his eighties when leftists told him his time on the Supreme Court was up. With Justice Sonia Sotomayor, despite being more than ten years Breyer’s junior when she retired, Josh Barro wrote for The Atlantic announced that it is time for him to retreat in the interest of liberalism as you will see in “Sonia Sotomayor Should Retire Now”
As you read Barro’s plea for Sotomayor to split the Supreme Court scene, you can sense his irritation with her for not willingly removing herself as a personal sacrifice for the greater cause of liberalism. :
Justice Sonia Sotomayor turns 70 in June. If he retires this year, President Joe Biden will nominate a young and credibly liberal judge to replace him. Republicans don’t control the Senate floor and can’t force the seat open like they did when Scalia died. The new justice’s confirmation would be a slam dunk, and liberals successfully retain one of their seats on the Court—playing the kind of defense that’s smart and smart when your only hope of regaining control of the Court rests on both timing the death or retirement of conservative justices and not losing your grip on the three seats you already hold.
But if Sotomayor doesn’t retire this year, we don’t know when she’ll be able to retire next with a likely liberal replacement. Democrats are likely to retain the presidency and Senate in this year’s elections, where the insurance provided by a Sotomayor retirement will no longer be needed. But if the Democrats lose the presidency or the Senate this fall—or both—he’ll have to stay on the bench until the party regains control. That could be just a few years, or it could be longer. Democrats previously had to wait 14 years (1995 to 2009). In other words, if Sotomayor doesn’t retire this year, she’ll be signaling that she’ll remain fit to serve until possibly age 78 or even 82 or 84—and she’ll be forcing the entire Democratic Party to do just that. the stakes are high for him.

Barro justifies his rather impolite desperation by citing his liberal nightmare of a 7-2 court:
If the Democrats lose the bet, the Court’s 6–3 conservative majority will become a 7–2 majority at some point within the next decade. If they won the bet, what did they win? They won the chance to read dissents written by Sotomayor instead of another liberal justice. This is obviously a crazy trade. Democrats talk a lot about the importance of the Court and the damage it has done since it moved in a more conservative direction, most obviously including ending constitutional protections for abortion rights. So why aren’t Democrats calling for Sotomayor’s retirement?
And now Barro is basically telling Sotomayor to leave the court.
Several Democrats close to the Biden administration and high-profile lawyers with previous White House experience spoke to West Wing Playbook on condition of anonymity about their support for Sotomayor’s retirement. But no one will record about it. They worry that publicly calling for the first Latina justice to step down will appear gauche or insensitive. Privately, they say Sotomayor provides an important liberal voice on the court, though they admit it would be wise for the party if she steps down before the 2024 election.
It’s incredibly unappetizing. You’re worried about putting control on the Court out of reach for more than a generation, but because she’s Latina, you can’t rush an official who puts your entire policy project in jeopardy? If this is how the Democratic Party operates, it deserves to lose.
Yeeeesh! Josh Barro appears to have no qualms about being gauche or insensitive by demanding that Sotomayor resign and any pretense of support for their sacred diversity be discarded in the interest of the greater liberal good.
