Doctor tied to early abortion pill trials later charged with Medicaid fraud

A Georgia doctor tied to early abortion pill trials has been reprimanded by the state’s medical regulatory agency over the abortion-surgery-related death of one of his patients. A few years later, he was arrested and convicted of Medicaid fraud.

Abortionist Tyrone Malloy was involved in early Population Council testing of the abortion pill (RU-486), now referred to as mifepristone. Documents on file with the US Food and Drug Administration (FDA) indicate that Malloy was a principal investigator on abortion pill trials in the 1990’s, before the drug was fully approved by the FDA.

A report published of the Atlanta Journal Constitution (AJC) in 2018 summarizes Malloy’s history.

“A Georgia medical board once authorized gynecologist Tyrone C. Malloy to perform a late-term abortion that left a woman bleeding uncontrollably, her abdomen swollen as she was rushed to an emergency room. He went into cardiac arrest and died,” the article said.

“Before that, the board cited him for medical malpractice in the death of a newborn just after a C-section,” the AJC wrote.

“Then the state Attorney General’s Office spent many years aggressively prosecuting him on felony charges, telling a DeKalb County jury that she fraudulently billed Georgia Medicaid more than $386,000 for office visits related to elective abortions and for ultrasounds she never performed. He spent 21 months in prison,” added AJC.

Documents filed with the FDA reveal that trials of the early abortion pill have been conducted at many abortion facilities, pro-abortion universities, and Planned Parenthood locations. These centers can, according to document, “performed abortions by either vacuum aspiration or dilatation and curettage and had access to facilities providing blood transfusions and performed routine emergency resuscitation procedures.” Malloy was listed among those investigators.

In addition, a separate document (photo below) detailed study presented in “New Drug Applications” by the Population Council of mifepristone indicated that Tyrone Malloy was a principal investigator of early abortion pill trials at the Feminist Women’s Health Center in Atlanta, Georgia, and was still listed as their Medical Director in 2002.

Malloy has worked in many abortion facilities, and according to her online bio, these include the Feminist Women’s Health Center and the Atlanta Surgi Center, Inc., both located in Atlanta, Georgia. An archive of abortionists website reveals that Malloy acted “as Principal Investigator in more than 70 research trials” and was a member of Planned Parenthood.

In 2000, Malloy was “identified” as a “cooperating investigator[s]” in a published studies in the early trial of the abortion pill.

Abortion Patient Death

A 2009 disciplinary action taken against the abortionist by the Composite State Board of Medical Examiners in Georgia indicated that on March 21, 2008, a 23-year-old abortion patient, referred to in the document as “SM,” went to the abortion facility of Summit Medical Association in Atlanta. There Malloy performed an “elective termination of her 25-week pregnancy.”

According to the report, “SM” went into cardiac arrest and was transferred to the Atlanta Medical Center, where she showed vaginal bleeding and a distended abdomen and “possible intraabdominal hemorrhage secondary to perforation.”

The document further states that “SM” had to undergo a hysterectomy and bowel repair and showed signs of DIC (disseminated intravascular coagulation, a clotting disorder) Medical records indicated that vigorous blood product replacement was performed, but sadly the woman was coded to the ICU where she died.

The Board of Medical Examiners issued a “public reprimand” against Malloy in the case, saying the abortionist “failed to adhere to minimal standards of acceptable and prevailing medical practice” in several ways. His license was revoked and while he was ordered to pay a $10,000 fine, he was allowed to continue training and abortion.

An additional location area for clinical trials of the early abortion pill is Preterm abortion facility in Ohio, where — in 2015 — surgical abortion client Lakisha Wilson died following a second-trimester abortion.

Medicaid Fraud

In 2014 Malloy was convicted of Medicaid fraud by the state of Georgia and was sentenced up to four years in prison. A press release published the Georgia Attorney General’s Office read, “Over several years, Malloy engaged in a scheme to defraud Georgia Medicaid by billing for office visits related to abortions and for ultrasound procedures that never did. In total, he fraudulently billed Georgia Medicaid over $386,000.

“Malloy is the owner of Old National Gynecology, a medical practice dedicated to performing first-trimester elective abortions. Federal funds may not be used to pay for abortions and services related to abortions, except in cases where the pregnancy is the result of rape or incest or circumstances where continuing the pregnancy would endanger life of mother The Georgia Medicaid program is supported by state and federal tax dollars. Over the course of several years, Malloy devised a scheme to defraud Georgia Medicaid by billing for office visits related to abortions and for ultrasound procedures that were never performed. In total, he fraudulently billed Georgia Medicaid more than $386,000,” the release also said.

“On March 21, 2014, DeKalb Superior Court Judge CJ Becker sentenced Tyrone Cecil Malloy, MD, to four years in prison and six years probation on two counts of Medicaid Fraud, OCGA § 49-4-146.1(b) (2). Malloy was found guilty by a jury on both counts on March 10, 2014, following a two-week trial,” the Georgia AG’s office also wrote.

Malloy claimed he was innocent and that the charges, which he said were later dropped, were politically motivated. He narrated the case to his website where he wrote, “The State won and I lost. The State expects me to serve a third of my sentence, 16 months; I served for 21 months. The restitution hearing will at least throw out the amount of money we are legally entitled to receive for the ultrasounds. Instead the State received money it was not entitled to. They ruined my reputation, ruined me financially and put an unbearable burden and stress on my family.”

In 2015, Malloy forfeited his medical license and “forfeited all rights, titles and privileges to practice medicine in the State of Georgia.”

However, Malloy was fully reinstated in 2018 after serving 21 months of his 48-month sentence.
