French Minister Supports Surrogacy | The Surrogacy Law Center

The French Minister of Labor, Oliver Dussopt, supports surrogacy and other reproductive technology options. He openly discussed this issue in an interview where he also discussed his sexual orientation amid attacks on his character and much social unrest in the country.

While Dussopt has been clear that marriage for all and assisted reproduction options for lesbian couples should both be available, she has also publicly said she supports surrogacy. However, he is quick to point out that it is important to have oversight and a strong legal framework surrounding this optionto protect all involved.

Currently, France has a complete ban on surrogacy in any form. No one is allowed to use it, regardless of their circumstances or the agreement of any party to it. The current government of Borne, led by President Macron, has made clear its beliefs that surrogacy crosses a line, and that it should not be allowed. Dussopt acknowledges that, but his opinion on the matter remains unchanged.

The French Ministry of Justice is currently working on a draft code that will recognize children born abroad to replace mothers. French judges will be able to address foreign surrogacy contracts that were not signed in France, and this will make domestic surrogacy administration an ineffective way to prevent this.

It is unclear whether the draft code will work for its intended purpose, or how many others within the French government may share Dussopt’s sentiments. There is a lot of stress and turmoil in the country at the moment, over the decision to raise the pension age. People are taking to the streets in protest, but Dussopt said his decision to speak out is not a diversion from other issues.

Instead, he is simply making his position on the issue clear, and the draft code at the Ministry of Justice seems to conform to an extent to Dussopt’s views on the matter. While legal surrogacy may eventually be possible in France, it is likely to be an uphill battle that will take some time to settle.
