What advice would you give to someone thinking about becoming a surrogate?
This is an excellent question. By the time my clients are referred to me, they have likely gone through several appointments, medical and psychological evaluations, gone through their own due diligence, thought through the entire process of assisted reproductive technology. They are well prepared by the time they talk to their lawyers.
The only advice I can give to a surrogate is that a surrogate has to be someone who is committed to helping a family go through assisted reproductive technology, the time, the effort, the commitment. These are things that I think would be critical to anyone thinking of becoming a surrogate.
How have surrogacy laws evolved over the years, and what trends do you see in the field?
I was very fortunate in 2003 when I first started as an assisted reproductive technology attorney. There is already existing case law that allows people to go through gestational surrogacy and donor arrangements. There is already an existing statutory law regarding sperm donation. So there are established laws. Since I’ve been a lawyer, there is now a statutory law regarding egg donation, and actually, a statutory law regarding embryo donation as well.
As far as trends go, I can’t say that there will or won’t be any major changes related to the law. I feel that the law now protects both intended parents and surrogates. Any attorney practicing in the field of assisted reproductive technology needs to be updated on the state of the law and make sure their clients are aware of any type of changes that may affect their assisted reproductive technology arrangements.
What has been the most rewarding part about working in this industry for you?
The most rewarding part is helping people with their family formation, whether it’s intended parents, surrogates assisting parents, egg donors and embryo donors assisting parents. . This is definitely the most rewarding part of my being a lawyer.
Another amazing thing is when we get a chance to see babies born as a result of surrogacy arrangements. It doesn’t happen often, but sometimes the intended parents may be on another trip, and they will bring their baby or child with them. And it’s great to see the children born as a result of egg donation, sperm donation, surrogacy arrangements that we help our clients with.
